Here Shroom End-User License Agreement

This End-User License Agreement (the "Agreement") is between you and FT Plus s.r.o. ("FT Plus", "we", "us") for the Here Shroom application (the "App"). By tapping Accept, you agree to this Agreement. If you do not agree, do not use the App.

1. Acknowledgement and Apple

This Agreement is concluded between you and FT Plus only, not Apple Inc. ("Apple"). FT Plus, not Apple, is solely responsible for the App and its content. This Agreement does not create usage rules that conflict with the Apple Media Services Terms and Conditions as of the effective date.

2. Scope of license

FT Plus grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing where Apple permits this.

You may not copy, reverse engineer, redistribute, rent, lease, sell, sublicense, or commercially exploit the App except where applicable law expressly permits it.

3. Informational field companion only

Here Shroom is a hobbyist field companion for recording foraging trips and browsing reference material. It is not professional, medical, legal, food-safety, toxicological, or expert foraging advice and is not a substitute for the judgement of a qualified local expert. Nothing in the App recommends that you pick, touch, keep, cook, consume, sell, share, or distribute any mushroom, plant, or other item.

Automated photo recognition is intentionally disabled in this TestFlight candidate. Recognition requests return no automated identification or confidence result, and you must use the manual Atlas picker and independent expert verification. A future automated provider requires separate approval and does not change the safety limits in this Agreement.

4. No identification or safety guarantee

To the maximum extent permitted by applicable law, FT Plus makes no guarantee, representation, or warranty about:

• the accuracy of any identification, name, category, rarity, suggestion, or reference material;
• whether anything is edible, safe, poisonous, allergenic, or fit for any purpose;
• the correctness of a location, map, route, distribution, or community heat overlay;
• any health effect, nutritional value, or foraging outcome; or
• the reliability, availability, security, or fitness of the App for a particular purpose.

The App is provided "AS IS" and "AS AVAILABLE", with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by applicable law.

5. Your responsibilities and assumption of risk

You are solely responsible for your decisions and actions. You agree to verify every mushroom, plant, and location independently with a qualified local expert and reliable local sources. Never consume, handle, prepare, sell, share, or distribute anything based solely on the App. You must comply with local laws, land-access rules, protected-species and conservation rules, and private-property rights.

Wild mushrooms can be deadly. To the maximum extent permitted by applicable law, you knowingly and voluntarily assume all risk from using the App and foraging, including poisoning, allergic or other adverse reactions, illness, death, misidentification, consumption, terrain, weather, water, wildlife, getting lost, trespass, legal exposure, and property damage.

6. Data, privacy, sharing, and deletion

The App stores data on your device first and works offline. Exact find locations and recorded GPS routes remain stored on the current device. While you are signed out, the App has no authenticated cloud session and does not send exact find locations or GPS routes to FT Plus. After you sign in with Apple, when online, the current App automatically synchronises supported pending and new trips, finds, photos, settings, and exact find locations to FT Plus servers for your owner-only account. If GPS route recording is enabled, a completed trip's exact breadcrumb route also synchronises after sign-in. Exact locations and routes are sent over encrypted transport and stored encrypted in owner-private storage.

The current App does not offer a separate local-only location switch. Signing out stops authenticated cloud synchronisation; it does not remove data already synchronised to your account. Turning GPS route recording off prevents new breadcrumb routes from being recorded, but marked finds still capture and retain their exact locations. Deleting a recorded trip or completing account-data deletion removes the applicable Here Shroom data within the scopes and retention limits described by the controls and privacy policy.

Specified device preferences remain on the device. Photos sent to the server are processed to remove embedded location metadata. A camera capture may also be saved as a separate copy in Apple Photos; Here Shroom cannot export or delete that Apple Photos copy. In the current TestFlight candidate, automated recognition is disabled: the App opens the manual picker without sending the photo for recognition, and the server independently refuses recognition image processing or persistence from older clients. If recognition is enabled in a future release, recognition photos may be retained for model improvement only when you separately enable that choice. Turning that choice off deletes the retained training copies for your account and prevents new retention.

Exact trip data remains owner-visible in this release. Trip visibility intent and anonymous community-map contribution are separate choices and remain effective after sign-in and synchronisation. Nothing contributes by default. A private trip may explicitly contribute to privacy-protected, aggregated community maps as described in the privacy policy, and the choice may be revoked. Signing in, synchronising private exact data, or accepting this Agreement is not consent to community contribution, recognition training, analytics, Apple Health, or route recording.

The App provides controls to export available server and current-device data and to request account data deletion. Without a valid cloud session, those controls export or delete only Here Shroom data on the current device and do not call authenticated server controls. A current-device export still requires Face ID, Touch ID, or the device passcode. Cloud data, if any, requires signing in to export or delete. Scope, retry, data not yet synchronised from a device, and any legally required retention exceptions are described in those controls and the privacy policy.

FT Plus's current privacy policy explains data categories, purposes, storage, processors, retention, security, and rights: https://ftplus.cz/privacy. The privacy policy forms a separate notice and does not replace this Agreement.

7. Apple services, HealthKit, maps, and purchases

The App may use Apple services including Sign in with Apple, MapKit, StoreKit, TestFlight, and, only when you enable it, Apple Health/HealthKit workout writing. Apple processes use of its services under Apple's terms and privacy policy.

During this TestFlight phase, Premium is a Sandbox purchase-status experiment only. It tests Apple's purchase and restore flow and FT Plus server verification, requires a signed-in Here Shroom cloud session, and does not unlock Community, heatmaps, or any other feature. A Sandbox transaction does not create a production subscription or charge the tester. FT Plus does not currently offer a production Here Shroom subscription. Any future paid benefit requires updated product information and legal terms.

The App does not provide medical or health advice. HealthKit data must not be used for diagnosis or treatment through the App.

8. Maintenance and support

FT Plus, not Apple, is solely responsible for maintenance and support for the App as stated in this Agreement or required by applicable law. Apple has no obligation whatsoever to provide maintenance or support for the App.

9. Warranty and Apple refund

FT Plus is solely responsible for any product warranty that cannot lawfully be disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation for the App. FT Plus is responsible for other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty, subject to the lawful limits in this Agreement.

10. Product and regulatory claims

FT Plus, not Apple, is responsible for addressing claims by you or a third party concerning the App or your possession or use of it, including product-liability claims, claims that the App fails to meet a legal or regulatory requirement, and claims under consumer-protection, privacy, or similar legislation, including claims connected with HealthKit. Nothing in this Agreement limits liability beyond what applicable law permits.

11. Intellectual property claims

If a third party claims that the App or your possession or use of it infringes intellectual property rights, FT Plus, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.

12. Legal and export compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on a U.S. Government list of prohibited or restricted parties. You must also comply with applicable local export, sanctions, and trade laws.

13. Third-party terms

You must comply with applicable third-party terms when using the App, including Apple Media Services, MapKit, HealthKit, network or wireless-data service, cloud, and content-provider terms. You are responsible for network and carrier charges.

14. Limitation of liability

To the maximum extent permitted by applicable law, FT Plus and its owners, employees, and contributors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of health, life, profits, data, goodwill, or other losses arising from use of or inability to use the App, even if advised of the possibility. You are not entitled to compensation or recompense except for a non-excludable remedy required by law. Where liability cannot be excluded, it is limited to the minimum permitted by law. Mandatory consumer rights remain unaffected.

15. Changes, re-acceptance, and termination

We may update this Agreement. A material version change requires acceptance before continued use. We may suspend or terminate the license where you materially breach this Agreement, subject to applicable law. On termination, you must stop using the App; provisions intended to survive remain in effect.

16. General

If part of this Agreement is unenforceable, the remainder stays effective. Failure to enforce a term is not a waiver. This Agreement is governed by the laws applicable at FT Plus's registered office, without excluding mandatory consumer protections or jurisdiction rights in your place of residence.

18. Apple as third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement. When you accept this Agreement, Apple has the right, and is deemed to have accepted the right, to enforce this Agreement against you as a third-party beneficiary.
